Remembering the Emergency on 25th June : Dark Days of Free India







SAMVIDHAN HATYA DIWAS 25 JUNE -      This day shall be the day to know the misuse  and  abuse of the Constitution of  India.  The following points needs to be discussed by every citizen of India  on Proclamation of Emergency on 25 June 1975 -

1.      The Jurisdiction  of the Supreme Court and the High Court in respect of Judicial review and issue of Writs was curtailed.

2.       Fundamental Rights guaranteed by Article 20(one person could be punished for one more  than once at the whims and fancies of the government against the principle of double jeopardy  ) and Article 21(Right to Life) were suspended.

3.       Ban on media for Publication and newspapers (suspension of Article 19 freedom of speech and expression etc)

4.       Power of the Court to decide the election disputes of the President, the Vice President the Prime Minister and the Speaker of the Lok Sabha was deleted

5.       Raising the tenure of Lok Sabha(Article 83) and the State Legislative Assemblies (Article 172)from 5 to 6 years.

6.      Extension  the one time duration of the President rule in a State(Article 356) from 6 months to 1 year.

7.       Requirement of Quorum in the Parliament(Article 100)and the State Legislatures  (Article 189)was deleted

8.      Shortened the procedure for disciplinary action  by taking away the right of a Civil Servant to make representation at the second stage after the enquiry that is on the penalty proposed.

 

9.       Gokul Bhai Bhatt ,freedom fighter and  active member of constituent assembly from Rajasthan ,remained in jail for about 18 months during the Emergency.
