  भारत का सर्वोच्च न्यायालय संवैधानिक नैतिकता से ऊपर नहीं है। समलैंगिक विवाह जैसे महत्वपूर्ण सामाजिक मुद्दों को संविधान सभा की बहसों से प्रेरणा लेकर हल किया जा सकता है। भारत के सर्वोच्च न्यायालय को संविधान निर्माण के दौरान अपनाए गए दृष्टिकोण पर गौर करना चाहिए। समायोजन  और आम सहमति संविधान के निर्माण के दौरान लिए गए सभी निर्णयों की पहचान थी। जब भी किसी मुद्दे पर आम सहमति की कमी थी, संविधान सभा द्वारा  बहुमत के दृष्टिकोण को लागू नहीं किया गया  था। महिलाओं को वोट  का अधिकार, एक विशेष आयु से ऊपर के भारत के सभी नागरिकों को वोट देने का अधिकार, अस्पृश्यता के निषेध के प्रावधान कुछ ऐसे मुद्दे थे जिन्हें संविधान द्वारा स्वीकार नहीं किया गया था। भारत ने  उन्हें  अपनाया गया था। इसका   कारण था कि सामाजिक तैयारी, भागीदारी और स्वीकृति का एक लंबा इतिहास था।  भारत की स्वतंत्रता के इतिहास को ध्यान से पढ़ने पर पता चलेगा कि इन मुद्दों पर सामाजिक सुधार भी साथ-साथ चल रहे थे। भारत के संविधान के प्रारंभ में देश के सभी नागरिकों द्वारा। ​संविधान सभा की बहस को पढ़ना और उसका अवलोकन करने  से  स्पष्ट रूप से दर्शाता

Ambedkar : Mr. Vice-President, I must confess that I am somewhat in a difficult position with regard to article 15 and the amendment moved by my Friend Pandit Bhargava for the deletion of the words "procedure according to law" and the substitution of the words "due process".   It is quite clear to any one who has listened to the debate that has taken place last time that there are two sharp points of view. One point of view says that "due process of law" must be there in this article; otherwise the article is a nugatory one. The other point of view is that the existing phraseology is quite sufficient for the purpose.
