26-10-1947  में जम्मू कश्मीर का विलयन भारत में हुआ . कश्मीर का भारत में विलय ब्रिटिश "भारतीय स्वातन्त्र्य अधिनियम 1947 " के तहत क़ानूनी तौर पर सही था। भारत की संविधान सभा में जम्मू कश्मीर का प्रतिनिधि :शेख मोहम्मद अब्दुल्ला ,मोतीराम बैग्रा, मिर्ज़ा मोहमद अफ़ज़ल बैग और मौलाना मोहमद सईद मसूदी । गोपाल स्वामी अय्यंगार की भूमिका अनुच्छेद 370 में महत्वपूर्ण थी .जम्मू  कश्मीर  राज्य को भारत के  संविधान के अनुच्छेद 370 के तहत स्वायत्तता प्राप्त है। जो की शुरू से ही अस्थियी प्रावधान की श्रेणी में संविधान के भाग 21  में वर्णित है. भाग21  में अस्थायी ,संक्रमणकालीन और विशेष प्रावधान वर्णित है.  14 मई 1954 को तत्कालीन राष्ट्रपति डॉ. राजेंद्र प्रसाद ने एक आदेश पारित किया था. इस आदेश के जरिए भारत के संविधान में एक नया अनुच्छेद 35A जोड़ दिया गया.इस संविधान के मुताबिक स्थायी नागरिक वो व्यक्ति है जो 14 मई 1954 को राज्य का नागरिक रहा हो या फिर उससे पहले के 10 वर्षों से राज्य में रह रहा हो. साथ ही उसने वहां संपत्ति हासिल की हो.  अनुच्छेद 35A धारा 370...
